THE INTERVAL
IKOU Loyalty Program Terms and Conditions

These Terms apply to membership in The Interval. By joining, a person agrees to these Terms. Joining The Interval is separate from consenting to receive promotional email or SMS marketing.
1. About The Interval

1.1 The Interval is the loyalty program operated by IKOU Australia Pty Ltd ABN 99 605 943 897 (IKOU, we, us or our). It rewards eligible customers based on their Eligible Spend and provides access to Rewards and benefits.
1.2 These Terms govern membership in The Interval. IKOU’s website terms, sale terms, refund policy and any additional terms issued with a Reward, promotion or event also apply where relevant.
1.3 If there is an inconsistency, the specific terms issued for a Reward, promotion or event apply to that Reward, promotion or event, and these Terms otherwise continue to apply.
1.4 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
2. Eligibility and joining

2.1 To join The Interval, a person must be at least 16 years old, have a valid email address and create or hold an eligible IKOU customer account. A person aged 16 or 17 confirms that they have the permission of a parent or guardian to join.
2.2 Membership is free, personal to the Member and limited to one Membership per person. A Membership, Spend Balance, Membership Level or Reward must not be sold, transferred, assigned or shared.
2.3 A person may join online or at a participating IKOU retail store by providing the information reasonably required to create and administer the Membership and accepting these Terms.
2.4 IKOU may decline an application where the eligibility requirements are not met, information is incomplete or inaccurate, or IKOU reasonably suspects fraud, misuse or duplicate Memberships.
2.5 IKOU employees and people who receive an ongoing staff, trade, wholesale, promotional or complimentary-product discount are not eligible unless IKOU expressly permits otherwise.
2.6 A Membership remains active unless it is cancelled by the Member or suspended or cancelled by IKOU. A Member is not required to make a purchase within the preceding 12 months to maintain an Active Membership.
2.7 The Member must keep their account and contact details accurate and secure. IKOU is not responsible for a Member missing a Reward or communication because their details are incorrect or out of date, their inbox or device settings prevent delivery, or circumstances outside IKOU’s reasonable control prevent delivery.

3. Eligible Spend
3.1 Eligible Spend is the product price actually paid by a Member for Qualifying Purchases during the previous rolling 12 months, after discounts and Rewards have been applied.
3.2 Eligible Spend includes GST or an equivalent sales tax included in the price paid for the products. It excludes:
- shipping and delivery charges;
- purchases of gift cards;
- separately charged duties, import taxes, service charges, payment-processing charges or other fees;
- cancelled orders, returns and refunds;
- amounts represented by a discount, promotional voucher or Reward; and
- purchases that exceed reasonable retail limits, appear wholesale in nature or are intended for resale or commercial purposes.
3.3 Where a gift card is used as a payment method for a Qualifying Purchase, the amount paid using the gift card counts towards Eligible Spend, provided the purchase otherwise qualifies under this section 3.
3.4 For an online purchase to be recorded automatically, the Member must be logged into the IKOU account associated with their Membership when the order is placed. Guest-checkout transactions may not be linked and may not count.
3.5 For an in-store purchase to be recorded, the Member must provide the email address associated with their Membership before the transaction is completed.
3.6 Eligible Spend will generally appear in the Member’s account within approximately 48 hours after an order is completed. A longer period may apply while an order is pending, under review, being fulfilled, cancelled, returned or refunded, or during peak trading periods.
3.7 Unless IKOU states otherwise, all thresholds and Reward values in these Terms are in Australian dollars (AUD). A Qualifying Purchase made in another currency will be converted to AUD using the exchange rate applied by IKOU or its payment provider when the transaction is processed. The converted AUD amount will be used to calculate Eligible Spend and Membership Level eligibility.
3.8 Where a Reward is redeemed in another currency, IKOU may apply a local-currency equivalent using the exchange rate applied by IKOU or its payment provider when the Reward is issued or redeemed. The Member’s bank or payment provider may apply its own exchange rate or fees, for which IKOU is not responsible.


4. Membership Levels
4.1 A Member’s Membership Level is determined by their Eligible Spend during the previous rolling 12 months.

4.2 Membership Levels are reviewed on an ongoing basis. A Member’s level may increase when Eligible Spend reaches a higher threshold and may decrease when purchases fall outside the rolling 12-month period or are returned, refunded or otherwise cease to qualify.
4.3 A level change will generally appear in the Member’s account within approximately 48 hours after the relevant purchase, expiry of older spend, return, refund or account adjustment is processed.
4.4 At the launch of The Interval, eligible existing IKOU customers who join using the same email address used for previous purchases will have eligible purchases from the 12 months before joining recognised when IKOU determines their starting Membership Level.
4.5 A Member with no recognised eligible purchase history starts at Level 1 – Reset.


5. Rewards and benefits
5.1 Depending on their Membership Level and eligibility, Members may receive benefits such as a Welcome Reward, Level Entry Reward, Anniversary Reward, birthday Reward, annual gift, exclusive offer, early access opportunity, complimentary gift or invitation to an event or experience.
5.2 The availability and details of ongoing benefits may vary by Membership Level and will be displayed in the Member’s account or communicated by IKOU. A benefit is subject to any eligibility criteria, redemption period, product exclusions, availability limits and other conditions advised at the time.
5.3 A Reward is personal to the Member, has no cash value and cannot be sold, transferred, assigned, exchanged for cash or store credit, or applied retrospectively to a completed purchase.
5.4 Each Reward expires on the date advised when it is issued. An expired Reward cannot be redeemed. IKOU may, but is not required to, extend or reinstate an expired Reward where it considers that fair and reasonable.
5.5 Unless the specific Reward terms state otherwise, a Reward is single use and cannot be used to purchase a gift card.
5.6 Multiple loyalty Rewards may be redeemed in one transaction where the terms of each Reward permit this. A Reward cannot be combined with another promotional offer, discount code or voucher unless IKOU expressly permits this. Particular products, services, promotions or collections may be excluded if the exclusion is clearly communicated before redemption.
5.7 Rewards and gifts are subject to reasonable availability limits. If a complimentary product or gift becomes unavailable, IKOU may provide a reasonably comparable substitute or, if that is not practicable, withdraw the affected offer.


6. Welcome Reward
6.1 A New Member who joins The Interval for the first time and has no previous eligible IKOU purchase history using the registered email address will receive a Welcome Reward of $15 off their first eligible purchase of $100 or more.

6.2 The $100 minimum spend is calculated after other applicable discounts have been applied and excludes gift cards, shipping, separately charged duties, import taxes and fees.
6.3 The Welcome Reward must be used on the New Member’s first eligible purchase after joining, before the expiry date advised when it is issued.
6.4 An existing IKOU customer whose previous eligible purchases are recognised under clause 4.4 is not eligible for the Welcome Reward. They may instead receive the Level Entry Reward described in clause.

7. Level Entry Rewards
7.1 A Member will receive the Level Entry Reward shown in the Membership Levels table in section 4 when they first qualify for the relevant Membership Level, subject to these Terms and any conditions advised when the Reward is issued.
7.2 An existing IKOU customer who joins at launch and immediately qualifies for Level 2, Level 3 or Level 4 will receive only the Level Entry Reward for the highest Membership Level for which they qualify. Lower-level entry Rewards do not accumulate or stack.
7.3 A Level Entry Reward is issued once only for each Membership Level. If a Member qualifies for more than one new Membership Level at the same time, only the Reward for the highest new level reached at that time will be issued.
7.4 Moving down to a lower Membership Level and later returning to a level for which a Level Entry Reward was already issued does not create a new entitlement to that Reward.

8. Anniversary Rewards
8.1 A Member with an Active Membership will receive an Anniversary Reward each year on their Anniversary Date. The Anniversary Reward is additional to any annual gift or other benefit available for the Member’s Membership Level.
8.2 The Anniversary Reward is based on the Member’s Membership Level on their Anniversary Date, as shown in the following table.

8.3 A change to the Member’s Membership Level after their Anniversary Date does not change an Anniversary Reward already issued.
8.4 An Anniversary Reward is issued once per Membership year, is personal to the Member and cannot be transferred, exchanged for cash or store credit, or applied retrospectively to a completed purchase.
8.5 An Anniversary Reward expires on the date advised when it is issued.
8.6 An Anniversary Reward is subject to these Terms and any additional conditions communicated when it is issued, including any applicable product exclusions, redemption period or promotional restrictions.
9. Using Rewards

9.1 To use a Reward online, the Member must be logged into the IKOU account associated with the Reward. To use a Reward in-store, the Member must provide the email address associated with their Membership before the transaction is completed.
9.2 Only the amount actually paid by the Member after a Reward is applied contributes to Eligible Spend.
9.3 If an order is cancelled or products are returned or refunded, IKOU may reverse or adjust the related Eligible Spend, Membership Level and any Reward earned from that transaction.
9.4 If a Member receives a refund for a purchase on which a Reward was used, the Reward will not ordinarily be reissued. IKOU may reissue or reinstate the Reward where required by law or where IKOU considers it fair and reasonable, including for an eligible exchange of the same or a substantially similar product.
9.5 IKOU may correct an obvious error in a Spend Balance, Membership Level or Reward record. Before cancelling a Reward already issued to a Member, IKOU will consider the nature of the error, whether the Member caused or knew of it, and whether cancellation would be fair and reasonable in the circumstances.

10. Member events
10.1 IKOU may offer Members complimentary or paid events, experiences or activities. Additional event terms, including eligibility, ticket price, venue rules, cancellation arrangements and any age or capacity restrictions, will be communicated before booking.
10.2 If IKOU cancels a paid event, the Member will receive a refund of the ticket price paid unless the Member accepts a reasonable alternative. If IKOU postpones an event or makes a major change and the Member cannot attend, the Member will receive any refund or other remedy required by applicable consumer law.
10.3 A Member is not ordinarily entitled to a refund because they change their mind or can no longer attend, unless the event terms provide otherwise or a refund is required by law.


11. Membership communications and marketing
11.1 IKOU may send service-related communications reasonably necessary to administer The Interval, including account verification, Spend Balance, Membership Level, Reward issue, redemption and expiry, security, suspension, cancellation and material change notices.
11.2 Joining The Interval is separate from agreeing to receive promotional email or SMS marketing. IKOU will send promotional communications only where the Member has consented or where sending is otherwise permitted by applicable law.
11.3 A Member may unsubscribe from promotional email or SMS communications at any time using the unsubscribe facility in the message, by updating available communication preferences or by contacting IKOU Customer Care. Unsubscribing from marketing does not cancel the Membership or prevent IKOU from sending necessary service-related communications.
11.4 A Member who does not receive promotional communications may miss benefits or offers that are available only through a marketing campaign, but any Reward already issued to the Member will remain visible in their account where the system supports this.


12. Privacy
12.1 IKOU collects and handles personal information to establish and administer Memberships, identify Members online and in-store, link eligible purchases, calculate Eligible Spend and Membership Levels, issue and redeem Rewards, prevent fraud and misuse, respond to enquiries, analyse and improve The Interval, and comply with law.
12.2 IKOU may collect a Member’s name, email address, telephone number, account details, purchase and return history, Reward activity, Membership Level and communication preferences. A date of birth is optional unless the Member wants to receive a birthday benefit.
12.3 If a Member does not provide information reasonably required to administer The Interval, IKOU may be unable to create or verify the Membership, link purchases, calculate Eligible Spend, issue or redeem a Reward, or provide a personalised benefit.
12.4 IKOU will handle personal information in accordance with applicable privacy law and its Privacy Policy at https://ikou.com.au/policies/privacy-policy. The Privacy Policy explains how a person may seek access to or correction of their personal information and make a privacy complaint.

13. Suspension, cancellation and misuse
13.1 A Member may cancel their Membership at any time through their account, where that function is available, or by contacting IKOU Customer Care.
13.2 On cancellation, the Member stops earning Eligible Spend and receiving benefits, and unused Rewards and future entitlements expire unless IKOU states otherwise or applicable law requires a different result.
13.3 IKOU may suspend or cancel a Membership, or reverse a Reward or account adjustment, where it
reasonably believes that the Member:
- has breached these Terms in a material way;
- has provided false or misleading information;
-has engaged in fraud, abuse, resale activity or other misuse of The Interval;
- has created or used duplicate accounts to obtain an improper benefit;
- has sold, transferred or improperly used a Reward; or
- has engaged in conduct that creates a material security, legal or operational risk for IKOU or other Members.
13.4 Where reasonably practicable, IKOU will notify the Member of the reason for a suspension or cancellation and provide a reasonable opportunity to respond before unused Rewards are cancelled. Immediate action may be taken where reasonably necessary to prevent fraud, security harm or unlawful
conduct.
13.5 IKOU may review duplicate profiles and, where operationally possible, merge accounts belonging to
the same person. Memberships belonging to different people cannot be combined.
14. Changes to or ending The Interval

14.1 IKOU may make reasonable changes to The Interval, these Terms, Membership Levels, thresholds,
Rewards or benefits to respond to customer needs, business requirements, legal or regulatory obligations, fraud or security risks, technical requirements, third-party platform changes or the availability of products and services.
14.2 IKOU will give reasonable prior notice of a material change that is likely to reduce an existing Member’s benefits. Unless urgent action is reasonably necessary for legal, security, fraud-prevention or technical reasons, IKOU will endeavour to give at least 30 days’ notice.
14.3 A material change will not ordinarily remove a Reward already issued before its stated expiry date. IKOU may still cancel or adjust a Reward where permitted under clauses 9 or 13 or where required by law.
14.4 IKOU may suspend or end The Interval. Where reasonably practicable, IKOU will give at least 30 days’ notice and explain the effective date, whether existing Rewards can still be used, the final redemption date and any transitional arrangements.
14.5 If a Member does not wish to continue after a change, they may cancel their Membership at any time.
15. Liability and matters outside IKOU’s control

15.1 Nothing in these Terms limits IKOU’s liability for a breach of a non-excludable consumer guarantee, negligence, wilful misconduct, fraud or any liability that cannot lawfully be limited or excluded.
15.2 Subject to clause 15.1 and to the maximum extent permitted by law, IKOU is not responsible for loss caused solely by:
-incorrect or outdated information provided by the Member;
- the Member’s failure to keep account access details secure;
- a Member’s failure to use a Reward before its expiry date;
- an outage, interruption or failure of a third-party system outside IKOU’s reasonable control; or
- an event outside IKOU’s reasonable control that prevents or delays the operation of The Interval.
15.3 IKOU will take reasonable steps to correct a system or administrative error affecting a Member’s Spend Balance, Membership Level or Reward once IKOU becomes aware of it.


16. Applicable law
16.1 These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
16.2 Clause

16.1 does not prevent a Member from relying on any mandatory right or protection that applies in the country or region where the Member lives or the relevant transaction occurs.
16.3 For Australian consumers, this includes rights under the Australian Consumer Law. For New Zealand
consumers, this includes rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986, where those laws apply.
16.4 If part of these Terms is illegal, invalid or unenforceable, it will be read down to the extent necessary or severed. The remaining Terms continue to apply.

18. Definitions
18.1 Active Membership means a Membership that has not been cancelled or suspended.
18.2 Anniversary Date means each annual anniversary of the date on which the Member joined The Interval.
18.3 Anniversary Reward means the Reward issued under section 8 to a Member with an Active Membership.
18.4 Eligible Spend has the meaning given in section 3.
18.5 IKOU means IKOU Australia Pty Ltd ABN 99 605 943 897.
18.6 Member means an individual accepted as a member of The Interval.
18.7 Membership means a Member’s participation in The Interval.
18.8 Membership Level means Level 1 – Reset, Level 2 – Restore, Level 3 – Renew or Level 4 – Radiate, determined
under section 4.
18.9 New Member means a person who joins The Interval for the first time and has no previous eligible IKOU
purchase history using the registered email address.

18.10 Qualifying Purchase means an eligible purchase made online while the Member is logged into their IKOU
account or at a participating IKOU retail store using the email address associated with the Membership, excluding
any amount that does not qualify under section 3.
18.11 Reward means a discount, product, gift, offer, benefit, experience, event invitation or other benefit made
available to a Member under The Interval.
18.12 Spend Balance means the Member’s total Eligible Spend during the previous rolling 12 months.
18.13 Terms means these terms and conditions, as amended from time to time in accordance with section 14.
18.14 The Interval means IKOU’s loyalty program described in these Terms.
